General conditions of sale
Pownership of the site: the site is the property of the company "Sellerie Bucéphale" in its entirety, as well as all rights relating thereto. Any reproduction, in whole or in part, is prohibited without the express prior authorization of Sellerie Bucéphale.
1. Acceptance of the general conditions of sale
The customer acknowledges having read, prior to placing the order, the general conditions of sale set out on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relations between Sellerie Bucéphaleand its customer. They will prevail over all other conditions appearing in any other document, unless prior, express and written exemption from Sellerie Bucéphale.
These general conditions of sale may be modified at any time by Sellerie Bucéphale, without notice. The applicable conditions will be those in force on the site at the time of validation of the order.
2. Order
Automatic recording systems are considered as proof of the nature and content of the order. The Sellerie Bucéphaleconfirms acceptance of its order to the customer at the e-mail address that the customer has communicated.
The sale will be concluded from the validation by Sellerie Bucéphaleof payment for the order, that is to say from the date of validation of payment for orders paid online via the platform online or by telephone, the date of receipt of the transfer to our bank account, or the date of receipt of the check.
The Sellerie Bucéphalereserves in any case the right to refuse or cancel any unpaid order or that of a customer with whom there is a dispute relating to the payment of a previous order.
3. Price and payment
The price is expressed in Euros, all taxes included. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed all taxes included. This price includes the price of the products, the costs of handling, packaging and conservation of the products and the transport costs. The price is payable in cash on the day of order confirmation. Payment is made via the chosen secure online platform, by bank transfer, by credit card by calling us on 06.50.06.49.94 on working days or by bank or postal check payable in France.
4. Retention of title clause
By express agreement, and in accordance with the provisions of the law of May 12, 1980, the products ordered remain the property of Sellerie Bucéphale until full payment of their price by the customer. In the event of non-performance of its obligations by the customer, whatever the cause, the Sellerie Bucéphale will be entitled to demand the immediate return of the products at the expense and risk of the customer.
5. Product availability and shipping:
1. Either the presence in stock of the product concerned, the indication "in stock" corresponds to the stock status of the Sellerie Bucéphale at the time of the order.
2. Either an availability time, the availability time corresponds to the stock supply time of the Sellerie Bucéphale. This deadline is communicated by the supplier and/or manufacturer of the product and varies depending on the type of product.
3. Either the mention "pre-order" if the products concerned are new products announced by the supplier and/or the manufacturer, with no known date of availability.
4. Either the mention "out of stock" if the product is temporarily unavailable from our suppliers.
Orders are processed, prepared and shipped, i.e. delivered to our carrier, within 24 hours, working days, unless otherwise stated on the site's home page (closed , displacement) from:
1. Receipt of the product by Sellerie Bucéphale, regarding products in availability,
2. Validation of payment by the customer when it is made by bank card online or by telephone, regarding products in stock at the time of this validation or receipt. Generally, orders are processed after payment has been validated when paid online or by telephone by credit card. Or the credit of the bank account of Sellerie Bucéphale if it is a payment by transfer, or the successful receipt of the correct check.
The “in stock” indications and availability times may vary between the date of the order and, depending on the case, the date of validation of payment. Availability times are also subject to change at the initiative of the supplier and/or manufacturer.
In such cases, availability times will be those in effect at the time of validation of payment.
6. Delivery
Delivery of orders is carried out by service providers independent of the company Sellerie Bucéphale and within the deadlines announced by these service providers.
Parcels are sent by colissimo with tracking delivered with signature and insurance for shipments to Switzerland. The deadlines announced by La Poste are usually a minimum of 72 hours working days for packages weighing less than 30kg.
The Sellerie Bucéphale, in any event, cannot be held responsible for the delivery times announced by the service providers.
To report to Sellerie Bucéphale any difficulty linked to delivery, the customer has free order tracking online, accessible via the order details in the customer account , as well as online help support to contact customer service. Whatever the place of delivery, this is carried out by direct delivery of the product to the announced recipient, or in the event of absence, to another person authorized for this purpose by the customer. In the absence of any recipient, a delivery notice is left at the delivery address. Any costs for new presentations are the responsibility of the customer. The customer is required to check the condition of the products upon receipt. In the event of damage, he must precisely mention his reservations on the delivery note, and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of article L 133 -3 of the Commercial Code. He must also inform Sellerie Bucéphale by registered letter with acknowledgment of receipt of any damage due to transport within eight (8) days following receipt.No complaints will be accepted in the event of non-compliance with these formalities.
Delivery can also, depending on the customer's choice, be made to a Mondial Relay relay point for France and certain European countries, the choice of relay point is made at the time of ordering. The delays generally observed are approximately 1 week, shipping and delivery included. Packages are delivered against signature. Please note, in the event of loss or damage Mondial Relay only compensates up to €25. Shipping with insurance may be possible at additional cost, contact us.
It is also possible for French and foreign customers to choose delivery by DPD, either at home or at a relay point (France only). The delivery time for France is generally 24 to 48 hours. Deliveries are made from Monday to Friday, delivery against signature.
Insurance is available as an option at an additional cost, contact us.
Please note, for products out of stock, or orders placed after 5 p.m., the order will only be prepared the next day, or upon receipt of the goods, the 24-hour or 48-hour period will not begin until that moment.
The risks are borne by the purchaser from the moment the products have left the premises of the Sellerie Bucéphale. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.
Please note, for livraison en relais pickup (DPD relay), you have 7 days to pick up your package. After this period, DPD returns it to us. The actual return costs will then be your responsibility, either invoiced if new shipment, in addition to the costs of this shipment, or deducted from the reimbursement of your order
7. Information on delivery times
In any contract having as its object the sale of a good, movable or the provision of a service to a consumer, the professional must, when the delivery of the good or the provision of the service is not immediate and if the agreed price exceeds thresholds set by regulation, indicate the deadline by which it undertakes to deliver the good or perform the service.
The consumer may terminate the contract for the sale of movable property or the provision of a service by registered letter with acknowledgment of receipt if the delivery date of the property or execution of the service exceeding seven days and not due to a case of force majeure. This contract is, where applicable, considered terminated upon receipt, by the seller or the service provider, of the letter by which the consumer informs him of his decision, if delivery has not taken place or if the service was not performed between the sending and receipt of this letter.
The consumer exercises this right within sixty working days from the date indicated for delivery of the goods or performance of the service.
The sums paid in advance for any order with Sellerie Bucéphale have the value of a deposit and will therefore not be returned in the event of cancellation by the buyer.
The Sellerie Bucéphale will, in any event, be released from its obligation to deliver in the event of the occurrence of a case of force majeure such as in particular war, riot, fire, strikes, accidents and the impossibility of being supplied or the non-performance by the customer of any of its obligations (payment of the price, accuracy of the information communicated by the customer such as than the delivery address ...).
8. Withdrawal
The customer has a withdrawal period of 14 days from 06/14/14 (article L121-21 of the Consumer Code) from the delivery date to return the product in its original original packaging for replacement or refund. Only the return or exchange of products in their original packaging, complete (accessories, instructions, etc.), in perfect condition, unused, undamaged, unworn, will be accepted. and accompanied by the return number, shipped within one week after obtaining the return agreement. Products sold in blister packs or with a warranty label must be returned as is. Otherwise, the package will be refused.
Shipping costs remain the responsibility of the customer.
The direct costs of returning the goods are the responsibility of the consumer. (Article L. 121-21-3 al. 2 of the Consumer Code).
The credit note is issued within 24 hours after receipt of the returned items. By default, a purchase voucher for the amount of this credit will be issued. The customer can expressly request a refund if he prefers this option. He must make the request as soon as he requests the return of the product. The refund will take place within 14 days following the date on which the customer exercised his right of withdrawal (article L121-20-1 of the Consumer Code).
Any shipment returned incomplete, without the original label or without its packaging will not be refunded or deduction will be made of the original new value from the estimated resale value of the product now considered to be of occasion. (Article L. 121-21-3 al. 3 of the Consumer Code).
As part of a sale to a country outside the SEPA zone, if you paid by bank card online, you can, if you wish, be reimbursed directly. If you used another means of payment (transfer, credit card payment by telephone), only a voucher may be offered to you.
In the case of reimbursement of an order made free of carriage, the amount of shipping costs, namely €9 to date will be deducted.
Sale or promotional items may benefit from the right of withdrawal, for these items, a voucher for the amount corresponding to the price of the products will be issued.
In the event of non-receipt of the return package 14 days after the customer's request, if the customer does not provide proof of sending the package within the allotted time frame (1 week after agreement), the items will be considered definitively accepted by the customer, and the return will be canceled (article L. 121-21-3 al. 1 of the Code of consumption).
Please note, items made or personalized especially for the customer (half-measure or custom-made items, embroidery, items made according to your color or size specifications, etc.).) as well as perishable products, cannot be returned, e.g.: food, boots, tailcoats, personalized items...
As part of the saddles, some of the models are available for possible testing, against deposit. We will not be able to accept returns for saddles ordered specially for the customer. Contact us before ordering for testing and product return arrangements.

9. Information present on the product sheets.
The information, in particular the photos, is published according to the indications given by the manufacturers. The Sellerie Bucéphale cannot be held responsible in the event of modifications made by the manufacturer to the product offered for sale.

The manufacturers indicated on the item sheets are indicative, in the event of supply difficulties, we undertake to provide you with an item of equivalent quality (example Feeling brand bit, replaced by an Axxel brand bit) .
10. Legal information
Personal information relating to the customer is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts. Failure to provide information will result in the order not being validated. 13.Disputes
Any order placed implies the customer's acceptance, without any restriction, of the seller's general conditions of sale. In the event of sale to a legal entity, any dispute relating to the sale (price, general terms and conditions, products, etc.) will be subject to French law before the Commercial Court of the seller's head office.
