General Terms and Conditions of Sale
Site ownership: the site is the property of the company "Sellerie Bucéphale" in its entirety, as well as all related rights. Any reproduction, in whole or in part, is prohibited without the express and prior authorization of Sellerie Bucéphale.
1. Acceptance of the general terms and conditions of sale
The customer acknowledges having read, prior to placing the order, the general terms and conditions of sale displayed on this screen and expressly declares acceptance without reservation. These general terms and conditions govern the contractual relationship between Sellerie Bucéphale and its customer. They shall prevail over any other conditions appearing in any other document, except for a prior, express, and written waiver by Sellerie Bucéphale.
These general terms and conditions of sale may be modified at any time by Sellerie Bucéphale, without notice. The applicable conditions will be those in effect on the site at the time the order is validated.
2. Order
Automatic recording systems are considered proof of the nature and content of the order. Sellerie Bucéphale confirms acceptance of the order to the customer at the email address provided by the customer.
The sale will be concluded upon Sellerie Bucéphale's validation of the payment of the order, that is to say the date of payment validation for orders paid online via the Caisse d'Epargne platform or by phone, the date of receipt of the transfer in our bank account, or the date of receipt of the check.
Sellerie Bucéphale reserves the right in any case to refuse or cancel any unpaid order or any order from a customer with whom there is a dispute regarding payment of a previous order.
3. Price and payment
The price is expressed in Euros, all taxes included. The price shown on the product pages does not include shipping. The price indicated in the order confirmation is the final price, all taxes included. This price includes the cost of the products, handling, packaging, and storage fees, as well as shipping costs. The price is payable in full on the day the order is confirmed. Payment is made via the secure platforms Payplug, Oney, Paypal, or Shopify Payments, by bank transfer, by bank or postal check payable in France, or by any payment method on site.
Installment payments via Oney are subject to the Oney Terms and Conditions.
4. Retention of title clause
By express agreement, and in accordance with the provisions of the law of May 12, 1980, ordered products remain the property of Sellerie Bucéphale until full payment of their price by the customer. In case of non-fulfillment of obligations by the customer, whatever the cause, Sellerie Bucéphale shall have the right to demand immediate return of the products at the customer's expense, risk, and peril.
5. Product availability and shipping:
1. Or the presence of the concerned product in stock, the indication "in stock" corresponds to the stock status of Sellerie Bucéphale at the time of the order.
2. Or an availability time, the availability time corresponds to the restocking time for Sellerie Bucéphale. This time is communicated by the supplier and/or manufacturer of the product and varies depending on the type of product.
3. Or the mention "pre-order" if the products concerned are new products announced by the supplier and/or manufacturer, with no known availability date.
4. Either the mention "out of stock" if the product is temporarily unavailable from our suppliers.
Orders are processed, prepared, and shipped, meaning handed over to our carrier, within 24 hours, business days, unless otherwise stated on the site's homepage (closure, relocation) starting from:
1. Receipt of the product by Sellerie Bucéphale, concerning products in availability,
2. Payment confirmation by the customer when made by online Credit Card, concerning products in stock at the time of this confirmation or receipt. Generally, orders are processed after payment confirmation when paid online by Credit Card. Or the crediting of Sellerie Bucéphale's bank account if payment is by bank transfer, or the proper receipt of a compliant check.
"In stock" indications and availability times may vary between the order date and, depending on the case, the payment confirmation date. Availability times may also be subject to change at the initiative of the supplier and/or manufacturer.
In such cases, the availability times will be those in effect at the time of payment confirmation.
6. Delivery
Order delivery is carried out by independent providers of Sellerie Bucéphale and within the timeframes announced by these providers.
Packages are shipped via DPD with delivery times of 24 to 48 hours. Deliveries take place Monday to Friday, with signature required.
In any case, Sellerie Bucéphale cannot be held responsible for delivery times announced by service providers.
To report any delivery-related difficulties to Sellerie Bucéphale, the customer has access to free order tracking. online, accessible via the order details in the customer account, as well as an online help support allowing contact with customer service. Regardless of the delivery location, it is made by direct handover of the product to the designated recipient, or in case of absence, to another person authorized by the customer. If no recipient is available, a delivery notice is left at the delivery address. Any fees for re-delivery attempts are the customer's responsibility. The customer must check the condition of the products upon receipt. In case of damage, they must precisely note their reservations on the delivery slip and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of article L 133-3 of the Commercial Code. They must also inform Sellerie Bucéphale by registered letter with acknowledgment of receipt of any transport-related damage within eight (8) days following receipt. No claim will be accepted if these formalities are not respected.
It is also possible for foreign customers to choose home delivery via DPD.
Delivery to Switzerland is carried out via Colissimo.

Please note, for out-of-stock products or orders placed after the store's closing time, the order will only be prepared the next day or upon receipt of the goods; the 24 or 48-hour period will then start at that time.
Risks are borne by the buyer from the moment the products leave Sellerie Bucéphale's premises. In case of damage during transport, a motivated complaint must be made to the carrier within three days of delivery.
7. Information on delivery times
In any contract involving the sale of a movable good or the provision of a service to a consumer, the professional must, when the delivery of the good or the provision of the service is not immediate and if the agreed price exceeds thresholds set by regulation, indicate the latest date by which they commit to deliver the good or perform the service.
The consumer may terminate the contract for the sale of movable goods or the provision of services by registered letter with acknowledgment of receipt in case of delivery or service execution delay exceeding seven days and not due to a case of force majeure. This contract is, if applicable, considered terminated upon receipt by the seller or service provider of the letter by which the consumer informs them of their decision, if delivery has not occurred or the service has not been performed between the sending and receipt of this letter.
The consumer exercises this right within sixty working days from the date indicated for the delivery of the good or the performance of the service.
Amounts paid in advance for any order at Sellerie Bucéphale are considered deposits and will therefore not be refunded in case of cancellation by the buyer.
Sellerie Bucéphale will, in any case, be released from its obligation to deliver in the event of force majeure such as war, riot, fire, strikes, accidents, inability to be supplied, or the customer's failure to fulfill any of their obligations (payment of the price, accuracy of information provided by the customer such as delivery address...).
8. Withdrawal
The customer has a withdrawal period of 14 days (article L121-20 of the Consumer Code) and 14 days from 06/14/14 (article L121-21 of the Consumer Code) from the delivery date to return the product in its original packaging for replacement or refund. Only returns or exchanges of products in their original, complete packaging (accessories, manual, etc...), in perfect condition, unused, undamaged, unworn, and accompanied by the return number, shipped within one week after obtaining return authorization will be accepted. Products sold in blister packs or with a warranty label must be returned as is. Otherwise, the package will be refused.
Shipping costs remain the responsibility of the customer.
The direct costs of returning the goods are the responsibility of the consumer. (Article L. 121-21-3 para. 2 of the Consumer Code).
The credit note will be issued within 24 hours after receipt of the returned items. By default, a voucher for the amount of this credit will be issued. The customer can expressly request a refund if they prefer this option. They must make this request at the time of the product return request. The refund will be made within 14 days from the date the customer exercised their right of withdrawal (article L121-20-1 of the Consumer Code).
Any shipment returned incomplete, without the original label, or without its packaging will not be refunded, or a deduction will be made from the original new value based on the estimated resale value of the product now considered used. (Article L. 121-21-3 para. 3 of the Consumer Code).
In the case of a refund for a free shipping order, the shipping cost, currently €9, will be deducted.
Discounted or promotional items may benefit from the right of withdrawal; for these items, a voucher for the amount corresponding to the product price will be issued.
If the return package is not received within 14 days after the customer's request, and if the customer does not provide proof of sending the package within the allotted time (1 week after agreement), the items will be considered definitively accepted by the customer, and the return will be canceled (Article L. 121-21-3 para. 1 of the Consumer Code).
Please note, items made or customized specifically for the customer (half-measure or custom-made items, embroidery, items made according to your color or size specifications...) as well as perishable products cannot be returned, e.g.: feed, boots, jackets, tailcoats, saddles, Passier bridles...
For saddles, the saddles in stock are available for possible trial, against a deposit. We cannot accept returns for saddles specially ordered for the customer.

Information, including photos, is published according to the details provided by the manufacturers. Sellerie Bucéphale cannot be held responsible for any changes made by the manufacturer to the product offered for sale.

The manufacturers indicated on the product sheets are for reference only; in case of supply difficulties, we commit to providing you with an item of equivalent quality (for example, a Feeling brand bit replaced by an Axxel brand bit).
10. Legal information
Personal information related to the customer is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts. Failure to provide information results in the order not being validated. In accordance with the "Data Protection and Liberties" law, the processing of personal information relating to clients has been declared to the National Commission on Informatics and Liberty (CNIL).
The client has (article 34 of the law of January 6, 1978) a right of access, modification, correction, and deletion of data concerning them, which they can exercise with Sellerie Bucéphale. Furthermore, Sellerie Bucéphale commits not to disclose, free of charge or for compensation, its clients' contact details to any third party.
11. Commitment to Data Protection
In accordance with the provisions of law no. 98-536 of July 1, 1998, transposing into the Intellectual Property Code Directive 96/9/EC of March 11, 1996, concerning the legal protection of databases, Sellerie Bucéphale is the producer and owner of all or part of the databases composing this site. By accessing this site, the client acknowledges that the data it contains is legally protected and, in accordance with the provisions of the aforementioned July 1, 1998 law, is prohibited from extracting, reusing, storing, reproducing, representing, or preserving, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or part qualitatively or quantitatively substantial, of the content of the databases on the site accessed..
12. Applicable Law
These general conditions are subject to French law. This applies to both substantive and procedural rules. In case of dispute or complaint, the consumer should first contact the seller to seek an amicable solution.
13. Disputes
Any order placed implies the customer's acceptance, without any restriction, of the seller's general terms and conditions of sale. In the case of a sale to a legal entity, any dispute relating to the sale (price, GTC, products…) will be subject to French law before the Commercial Court of the seller's head office.
