General terms of sale
Site ownership: the site is the property of the company "Sellerie Bucéphale" in its entirety, as well as all related rights. Any reproduction, in whole or in part, is prohibited except with the express and prior authorization of Sellerie Bucéphale.
1. Acceptance of the general terms and conditions of sale
The customer acknowledges having read, prior to placing the order, the general terms and conditions of sale stated on this screen and expressly declares acceptance without reservation. These general terms and conditions of sale govern the contractual relationship between Sellerie Bucéphale and its customer. They shall prevail over any other conditions appearing in any other document, except for prior, express, and written derogation by Sellerie Bucéphale.
These general terms and conditions of sale may be modified at any time by Sellerie Bucéphale, without notice. The applicable conditions will be those in effect on the site at the time of order validation.
2. Order
Automatic recording systems are considered as proof of the nature and content of the order. Sellerie Bucéphale confirms the acceptance of the order to the customer at the e-mail address provided by them.
The sale will be concluded upon validation by Sellerie Bucéphale of the payment of the order, that is to say the date of payment validation for orders paid online via the Caisse d'Epargne platform or by phone, the date of receipt of the transfer on our bank account, or the date of receipt of the check.
Sellerie Bucéphale reserves in any case the right to refuse or cancel any unpaid order or that of a customer with whom there is a dispute relating to the payment of a previous order.
3. Price and payment
The price is expressed in Euros, all taxes included. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed all taxes included. This price includes the price of the products, handling, packaging and storage fees, and transport costs. The price is payable in cash on the day of order confirmation. Payment is made via the secure platforms Payplug, Oney, Paypal or Shopify Payments, by bank transfer, by bank or postal check payable in France, or any payment method on site.
Payments in installments via Oney are subject to the CGV de Oney .
4. Retention of title clause
By express agreement, and in accordance with the provisions of the law of May 12, 1980, the ordered products remain the property of Sellerie Bucéphale until full payment of their price by the customer. In case of non-fulfillment of its obligations by the customer, whatever the cause, Sellerie Bucéphale shall be entitled to demand the immediate return of the products at the customer's expense, risk, and peril.
5. Availability and shipping of products:
1. Or the presence in stock of the concerned product, the indication "in stock" corresponds to the stock status of Sellerie Bucéphale at the time of the order.
2. Or an availability delay, the availability delay corresponds to the restocking time of Sellerie Bucéphale. This delay is communicated by the supplier and/or the product manufacturer and varies depending on the type of product.
3. Or the mention "pre-order" if the products concerned are new products announced by the supplier and/or manufacturer, without a known availability date.
4. Either the mention "out of stock" if the product is temporarily unavailable from our suppliers.
Orders are processed, prepared, and shipped, that is to say handed over to our carrier, within 24 hours, business days, unless otherwise stated on the site's homepage (closure, relocation) from:
1. The receipt of the product by Sellerie Bucéphale, concerning products in stock,
2. Payment validation by the customer when made by Credit Card online, concerning products in stock at the time of this validation or receipt. Generally, orders are processed after payment validation when paid online by Credit Card. Or the crediting of Sellerie Bucéphale's bank account if payment is made by bank transfer, or the proper receipt of the compliant check.
"In stock" indications and availability times may vary between the order date and, as the case may be, the payment validation date. Availability times may also be subject to change at the initiative of the supplier and/or manufacturer.
In such cases, the availability times will be those in effect at the time of payment validation.
6. Delivery
Order delivery is carried out by independent service providers of Sellerie Bucéphale and within the times announced by these providers.
Parcels are shipped via DPD with delivery times of 24 to 48h. Deliveries are made Monday to Friday, against signature.
Sellerie Bucéphale, in any case, cannot be held responsible for delivery times announced by the service providers.
To report any delivery difficulties to Sellerie Bucéphale, the customer has access to free order tracking online, accessible via the order details on the customer account, as well as an online help support allowing contact with customer service. Whatever the delivery location, it is carried out by direct handover of the product to the announced recipient, or in case of absence, to another person authorized for this purpose by the customer. In the absence of any recipient, a delivery notice is left at the delivery address. Any fees for re-deliveries are the customer's responsibility. The customer is required to check the condition of the products upon receipt. In case of damage, they must precisely note their reservations on the delivery slip, and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of article L 133-3 of the Commercial Code. They must also inform Sellerie Bucéphale by registered letter with acknowledgment of receipt of any transport-related damage within eight (8) days following receipt. No claim will be accepted if these formalities are not respected.
It is also possible for foreign customers to choose home delivery via DPD.
Delivery to Switzerland is carried out by Colissimo.

Attention, for out-of-stock products, or orders placed after the store's closing time, the order will only be prepared the next day, or upon receipt of the merchandise, the 24h or 48h delay will then only start at that time.
Risks are borne by the buyer from the moment the products leave the premises of Sellerie Bucéphale. In case of damage during transport, a motivated complaint must be made to the carrier within three days of delivery.
7. Information on delivery times
In any contract for the sale of a good, movable or the provision of a service to a consumer, the professional must, when the delivery of the good or the provision of the service is not immediate and if the agreed price exceeds thresholds set by regulation, indicate the deadline by which they commit to deliver the good or perform the service.
The consumer may terminate the contract for the sale of a movable good or the provision of a service by registered letter with acknowledgment of receipt in case of exceeding the delivery date of the good or the execution of the service by more than seven days and not due to a case of force majeure. This contract is, if applicable, considered terminated upon receipt by the seller or service provider of the letter by which the consumer informs them of their decision, if delivery has not occurred or the service has not been performed between the sending and receipt of this letter.
The consumer exercises this right within sixty working days from the date indicated for the delivery of the good or the performance of the service.
Amounts paid in advance for any order at Sellerie Bucéphale are considered deposits and will therefore not be refunded in case of cancellation by the buyer.
Sellerie Bucéphale will, in any case, be released from its obligation to deliver in the event of force majeure such as war, riot, fire, strikes, accidents, inability to be supplied, or the client's failure to fulfill any of their obligations (payment of the price, accuracy of information provided by the client such as the delivery address...).
8. Withdrawal
The customer has a withdrawal period of 14 days (article L121-20 of the Consumer Code) and 14 days from 14/06/14 (article L121-21 of the Consumer Code) from the date of delivery to return the product in its original packaging for replacement or refund. Only returns or exchanges of products in their original, complete packaging (accessories, instructions, etc...), in perfect condition, unused, undamaged, unworn, and accompanied by the return number, shipped within one week after obtaining return approval will be accepted. Products sold in blister packs or with a warranty label must be returned as is. Otherwise, the package will be refused.
Shipping costs remain the responsibility of the customer.
The direct costs of returning goods are borne by the consumer. (Article L. 121-21-3 para. 2 of the Consumer Code).
The issuance of a credit note is made within 24 hours after receipt of the returned items. By default, a voucher for the amount of this credit will be issued. The customer can expressly request a refund if they prefer this option. They must make the request at the time of the product return request. The refund will take place within 14 days following the date on which the customer exercised their right of withdrawal (article L121-20-1 of the Consumer Code).
Any shipment returned incomplete, without the original label or without its packaging will not be refunded or a deduction will be made from the original new value the estimated resale value of the product now considered used. (Article L. 121-21-3 para. 3 of the Consumer Code).
In the case of a refund for an order made with free shipping, the amount of the shipping costs, currently 9€, will be deducted.
Discounted or promotional items may benefit from the right of withdrawal; for these items, a voucher for the amount corresponding to the price of the products will be issued.
In case of non-receipt of the return package 14 days after the customer's request, if the customer does not provide proof of sending the package within the allotted time (1 week after agreement), the items will be considered definitively accepted by the customer, and the return will be canceled (article L. 121-21-3 para. 1 of the Consumer Code).
Attention, items manufactured or customized especially for the customer (half-measure or custom-made items, embroidery, items made according to your color or size indications....) as well as perishable products cannot be returned, e.g.: food, boots, jackets, tailcoats, saddles, Passier bridles.....
For saddles, the saddles in stock are available for a possible trial, against a deposit. We will not accept returns for saddles specially ordered for the customer.

9. Information present on the product sheets.
The information, including photos, is published according to the indications given by the manufacturers. Sellerie Bucéphale cannot be held responsible for any modifications made by the manufacturer to the product offered for sale.
The photos are published for informational purposes only and are non-contractual.
The manufacturers indicated on the product sheets are indicative; in case of supply difficulties, we commit to providing you with an item of equivalent quality (for example, a bit of the Feeling brand replaced by a bit of the Axxel brand).
10. Legal information
Personal information relating to the client is essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide information results in the order not being validated. In accordance with the "Informatique et Libertés" law, the processing of personal information relating to clients has been declared to the National Commission on Informatics and Liberty (CNIL).
The client has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning them, which they can exercise with Sellerie Bucéphale. Furthermore, Sellerie Bucéphale commits not to communicate, free of charge or for consideration, its clients' contact details to any third party.
11. Commitment to data protection
In accordance with the provisions of law no. 98-536 of July 1, 1998, transposing into the Intellectual Property Code Directive 96/9/EC of March 11, 1996, concerning the legal protection of databases, Sellerie Bucéphale is the producer and owner of all or part of the databases composing this site. By accessing this site, the client acknowledges that the data composing it are legally protected and, in accordance with the provisions of the aforementioned law of July 1, 1998, expressly forbids extracting, reusing, storing, reproducing, representing or preserving, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or part qualitatively or quantitatively substantial, of the content of the databases appearing on the site accessed..
12. Applicable law
These general conditions are subject to French law. This applies to both substantive and procedural rules. In case of dispute or complaint, the consumer will first contact the seller to obtain an amicable solution.
13. Disputes
Any order placed implies the customer's acceptance, without any restriction, of the seller's general terms and conditions of sale. In the case of a sale to a legal entity, any dispute relating to the sale (price, GTC, products...) will be subject to French law before the Commercial Court of the seller's registered office.
