General conditions of sale

1. Acceptance of the general conditions of sale
The customer acknowledges having read, prior to placing an order, the general conditions of sale stated on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relations between the Sellerie Bucéphale and its client. They will prevail over any other conditions appearing in any other document, unless prior, express and written waiver by the Sellerie Bucéphale .
These general conditions of sale may be modified at any time by the Sellerie Bucéphale , without notice. The applicable conditions will be those in force on the site at the time of validation of the order.
2. Order
Automatic recording systems are considered as proof of the nature and content of the order. Sellerie Bucéphale confirms acceptance of the order to the customer at the email address provided by the customer.
The sale will be concluded upon validation by the Sellerie Bucéphale payment of the order, i.e. the date of validation of the payment for orders paid online via the online platform or by telephone, the date of receipt of the transfer into our bank account, or the date of receipt of the check.

3. Price and payment
The price is expressed in Euros, all taxes included. The price indicated on the product sheets does not include shipping. The price indicated in the order confirmation is the final price, expressed all taxes included. This price includes the price of the products, handling, packaging and storage costs, and shipping costs. The price is payable in cash on the day of the order confirmation. Payment is made via the secure online platform chosen, by bank transfer, by credit card by calling us at 06.50.06.49.94 on business days, or by bank or postal check payable in France.
4. Retention of title clause
By express agreement, and in accordance with the provisions of the law of May 12, 1980, the products ordered remain the property of the Sellerie Bucéphale until full payment of their price by the customer. In the event of non-performance of its obligations by the customer, whatever the cause, the Sellerie Bucéphale will be entitled to demand the immediate return of the products at the customer's expense, risk and peril.
5. Availability and shipping of products:
1. Either the presence in stock of the product concerned, the indication "in stock" corresponds to the stock status of the Sellerie Bucéphale at the time of ordering.

6. Delivery
Delivery of orders is carried out by service providers independent of the company Sellerie Bucéphale and within the timeframes announced by these service providers.
Packages are shipped in colissimo follow-up provided avec signature and insurance for shipments to Switzerland. Delivery times announced by La Poste are usually a minimum of 72 hours on working days for packages weighing less than 30 kg.
There Sellerie Bucéphale, in any event, cannot be held responsible for delivery times announced by service providers.
To report to the Sellerie Bucéphale any difficulty related to delivery, the customer has free order tracking online, accessible via the order details in the customer account, as well as online help support allowing you to contact customer service. Regardless of the delivery location, delivery is made by direct delivery of the product to the recipient indicated, or in the event of absence, to another person authorized for this purpose by the customer. Delivery can also, depending on the customer's choice, be made to a relay point. Mondial Relay For France and certain European countries, the choice of relay point is made at the time of ordering. Delivery times are generally around 1 week, including shipping and delivery. Packages are delivered against signature. Please note: in case of loss or damage Mondial Relay only compensates up to €25. Insured shipping may be possible at an additional cost, please contact us.
French and international customers can also choose DPD delivery, either to their home or to a collection point (France only). Delivery times for France are generally 24 to 48 hours. Deliveries are made Monday to Friday, with signature required.
Insurance is available as an option at an additional cost, please contact us.
Please note that for products out of stock, or orders placed after 5 p.m., the order will not be prepared until the next day, or upon receipt of the goods, the 24 or 48 hour period will only begin at that time.
The risks are borne by the purchaser from the moment the products leave the premises of the Sellerie BucéphaleIn the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.
Attention, for the livraison en relais pickup (DPD relay), you have 7 days to collect your package. After this period, DPD will return it to us. 7. Information on delivery times
In any contract for the sale of goods, movable property or the provision of services to a consumer, the professional must, when the delivery of the goods or the provision of the service is not immediate and if the agreed price exceeds thresholds set by regulation, indicate the deadline by which he undertakes to deliver the goods or perform the service.
The consumer may terminate the contract for the sale of movable property or the provision of services by registered letter with acknowledgement of receipt if the delivery date of the property or performance of the service is exceeded by more than seven days and not due to a case of force majeure. The consumer exercises this right within sixty working days from the date indicated for the delivery of the goods or the performance of the service.
The amounts paid in advance for any order with the Sellerie Bucéphale have the value of a deposit and will therefore not be returned in the event of cancellation by the buyer.
There Sellerie Bucéphale will, in any event, be released from its obligation to deliver in the event of the occurrence of a case of force majeure such as, in particular, war, riot, fire, strikes, accidents and the impossibility of being supplied or the non-performance by the customer of any of its obligations (payment of the price, accuracy of the information communicated by the customer such as the delivery address, etc.).).
8. Withdrawal
The customer has a 14-day withdrawal period from 06/14/14 (article L121-21 of the Consumer Code) from the delivery date to return the product in its original packaging for replacement or refund. Only the return or exchange of products will be accepted. in their original packaging, complete (accessories, instructions, etc.), in perfect condition, unused, undamaged, unworn, and accompanied by the return number, shipped within one week after obtaining the return agreement. Products sold in blister packs or with a warranty label must be returned as is. Otherwise, the package will be refused.
Shipping costs remain the responsibility of the customer.
The direct costs of returning the goods are the responsibility of the consumer. (Article L. 121-21-3 al. 2 of the Consumer Code).
Credit notes are issued within 24 hours of receiving the returned items. By default, a voucher for the amount of this credit note will be issued. The customer can expressly request a refund if they prefer this option. They must request it when requesting the return of the product. The refund will be issued within 14 days following the date on which the customer exercised their right of withdrawal (Article L121-20-1 of the French Consumer Code).
Any shipment returned incomplete, without the original label or without its packaging will not be refunded or the estimated resale value of the product, now considered used, will be deducted from the original new value. (Article L. 121-21-3 al. 3 of the Consumer Code).
For a sale to a country outside the SEPA zone, if you paid by credit card online, you can, if you wish, receive a direct refund. If you used another payment method (bank transfer, credit card payment by phone), you will only be offered a voucher.
In the case of a refund for an order placed postage-free, the amount of the postage costs, namely €9 to date, will be deducted.
Items on sale or on promotion may benefit from the right of withdrawal. For these items, a voucher for the amount corresponding to the price of the products will be issued.
In the event of non-receipt of the return package 14 days after the customer's request, if the customer does not provide proof of sending the package within the time limit (1 week after agreement), the items will be considered definitively accepted by the customer, and the return will be cancelled (article L. 121-21-3 al. 1 of the Consumer Code).
Please note that items made or personalized especially for the customer (half-measure or made-to-measure items, embroidery, items made according to your color or size specifications, etc.) as well as perishable products cannot be returned, e.g.: food, boots, tailcoats, personalized items, etc.
As part of the stools, some of the models are available for possible testing, against deposit. We will not be able to accept returns for saddles ordered specially for the customer. Contact us before ordering for the terms of testing and product return.

9. Information on product sheets.
The information, including photos, is published according to the instructions given by the manufacturers. Sellerie Bucéphale cannot be held responsible for any modifications made by the manufacturer to the product on sale.
The photos are published for information purposes only and are not contractually binding.
The manufacturers indicated on the product sheets are indicative, in the event of supply difficulties, we undertake to provide you with an item of equivalent quality (example: Feeling brand bit, replaced by an Axxel brand bit).
10. Legal information
Personal information relating to the customer is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts.
